Creo Network Outreach Terms

Presented through the Platform and accepted electronically (by an affirmative click) before a user may access Network Data or use outreach functionality. The current, controlling version is maintained on the Platform and may be updated pursuant to Section 13.10 of the Master Services Agreement.

These Creo Network Outreach Terms govern access to and use of Network Data and the Network's outreach functionality, and are incorporated into the Agreement by reference pursuant to Section 13.4.

1. Authority

You represent that you are authorized to accept these terms on behalf of your business and to bind it.

2. License to View

Creo grants you a limited, non-exclusive, non-transferable right to view and use Network Data made available to you solely for your internal, legitimate business-to-business purposes.

3. You Initiate Contact

You acknowledge that you — not Creo — identify and initiate any contact with a business surfaced through the Network. You are solely responsible for your communications and for determining that they are lawful.

4. Use Restrictions

You shall not: (a) sell, license, sublicense, redistribute, scrape, harvest, or copy Network Data into any other database, product, or service; (b) use Network Data to send unlawful, deceptive, or unsolicited communications; (c) use automated means to extract Network Data; or (d) use Network Data for any purpose other than as permitted herein.

5. Compliance with Law

You shall comply with all applicable laws governing your outreach and use of data, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and applicable state anti-spam, telemarketing, and privacy laws.

6. No Warranty

Network Data is provided "AS IS." Creo does not verify businesses or guarantee the accuracy, completeness, or currency of Network Data.

7. Indemnity

You will indemnify Creo against claims arising from your access to, use of, or outreach using Network Data, or your breach of these terms.

8. Suspension

Creo may suspend or revoke your access to the Network for any violation of these terms.

9. Changes

Creo may update these terms on notice; continued use after the effective date constitutes acceptance.

Exhibit B — Network Data Schedule

This Schedule identifies the data elements made available through the Creo Network. Data is tiered by source and sensitivity. Member Network Data is provided by, and made available at the election of, the Network Member. Non-Member Network Data is limited to business-entity information and contains no personal identifiers.
