Agreement to Terms

Welcome to Creo AI. By accessing or using our AI-powered marketing platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and Creo AI.

Definitions

• "Service" refers to the Creo AI platform, website, applications, and all related services
• "User," "you," or "your" refers to the individual or entity using our Services
• "Content" refers to text, images, data, and other materials uploaded, created, or generated using our Services
• "AI-Generated Content" refers to content created by our artificial intelligence systems

Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

Account Registration and Security

When you create an account with Creo AI:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use
• You may not share your account or credentials with others
• We reserve the right to suspend or terminate accounts that violate these Terms

Subscription and Payment Terms

Subscription Plans

Creo AI offers various subscription plans with different features and pricing. By subscribing, you agree to pay all applicable fees.

Billing

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• You authorize us to charge your payment method for all fees
• All fees are non-refundable except as required by law
• We may change our fees with 30 days' notice
• Failure to pay may result in service suspension or termination

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be provided for partial subscription periods.

Acceptable Use Policy

You agree NOT to use our Services to:

• Violate any laws, regulations, or third-party rights
• Generate or distribute spam, malware, or malicious content
• Harass, abuse, or harm others
• Impersonate any person or entity
• Infringe intellectual property rights
• Generate misleading, fraudulent, or deceptive content
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or reverse engineer our Services
• Use our Services for competitive analysis or to build competing products
• Generate content that violates our content policies (hate speech, violence, illegal activities)

Intellectual Property Rights

Our Rights

Creo AI owns all rights, title, and interest in and to the Services, including all software, designs, trademarks, and proprietary technology. These Terms do not grant you any ownership rights to our intellectual property.

Your Content

You retain ownership of all content you upload or create ("Your Content"). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process and store Your Content to provide the Services
• Use aggregated and anonymized data to improve our AI models
• Display Your Content back to you within the Services

AI-Generated Content

Subject to your compliance with these Terms and payment of applicable fees, you own the AI-generated content created using our Services. However, you acknowledge that:

• AI-generated content may not be unique to you
• Similar or identical outputs may be generated for other users
• You are responsible for reviewing and ensuring AI-generated content meets your needs
• You must comply with all applicable laws when using AI-generated content

AI Services and Limitations

Our AI-powered Services are provided "as is" and you acknowledge:

• AI-generated content may contain errors, inaccuracies, or biases
• AI outputs should be reviewed and verified before use
• We do not guarantee the accuracy, completeness, or quality of AI-generated content
• You are solely responsible for your use of AI-generated content
• AI capabilities and features may change or improve over time

Service Availability and Changes

We strive to provide reliable Services, but:

• Services may be temporarily unavailable due to maintenance or technical issues
• We may modify, suspend, or discontinue features at any time
• We will provide reasonable notice for significant changes when possible
• We do not guarantee uninterrupted or error-free service

Data Privacy and Security

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy. By using our Services, you agree to our data practices as described in the Privacy Policy.

We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You are responsible for maintaining the security of your account and data.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREO AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Creo AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content or AI-generated content you create

Termination

We may suspend or terminate your access to the Services:

• For violation of these Terms
• For non-payment of fees
• For fraudulent or illegal activity
• At our discretion with or without cause

Upon termination:

• Your right to use the Services immediately ceases
• You remain responsible for any fees owed
• We may delete your account and data after a reasonable period
• Provisions that by their nature should survive will remain in effect

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Columbia County, Georgia, and you consent to personal jurisdiction in such courts.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Creo AI regarding the Services.

Modifications

We may modify these Terms at any time. We will provide notice of material changes. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
